DISCLOSURE TEXT ON THE PROCESSING OF PERSONAL DATA 

I. THE DATA CONTROLLER AND THE PURPOSE OF THE TEXT

This text has been prepared by Mahanoğlu Law Firm (Address: Mahmudiye Mah, 4820 Street, No:2/37, Akdeniz/MERSIN) as data controller in accordance with Article 10 of Law n.6698 and the Declaration on the Procedures and Principles to be Followed in the Fulfillment of the Disclosure Obligation. 

The purpose of this Disclosure Text is to inform the visitor about their rights, the processing of personal data obtained automatically through the placement of cookies by our website to their device, the purposes and types of cookies that are used, as well as the legal reasons for the processing of the data in curriculum vitae documents that contain personal data that are sent via the document upload button on our website.

II. THE PURPOSE OF PROCESSING PERSONAL DATA

According to Article 2 of Attorneyship Law the purpose of attorneyship is “to ensure with juridical bodies at every level, arbitrators, public and private entities, boards and agencies the arrangement of legal relations, the just and fair settlement of all kinds of legal issues and disputes, and the full implementation of legal rules.” 

Our website has been created accordingly in order to expedite the services we offer to both our clients and potential clients, to provide ease of access to our services and to inform them. 

During the time our website is in use, due to the nature of the web sites and the digital world, personal data of the users are collected automatically in order for the site to process and provide better service. In addition, users (data subjects) can also manually provide data flow to the website and these data are also collected and processed by Mahanoglu Law Firm in accordance with the Law on the Protection of Personal Data No. 6698 in the capacity of data controller.

Collected personal data is processed according to Article 5 and 6 of the Law on the Protection of Personal Data, in order to develop the performance of the web site and improve the online experience of our visitors. Personal data is also processed to measure the traffic to the site in order to provide a more useful and updated web site that allows for customized search results enabling visitors to reach to more relevant articles, information, and referrals. All this data is processed for the ensuring a more efficient communication with visitors. 

III. THE RECIPIENTS, TO WHOM PERSONAL DATA MAY BE TRANSFERRED AND THE PURPOSE OF THE TRANSFER

Collected personal data is processed only by our related team member in our office and would not be transferred to any institution, organization. But in the possibility that visitors (data subjects) are informed or they give their consent to the transfer, personal data can be transferred to recipients with the legal procedures compatible to Article 8 of the Personal Data Protection Law. The circumstances in which the Personal Data Protection Law does not require consent to be able to process and transfer data are reserved. 

IV. THE METHOD AND LEGAL REASON FOR THE COLLECTION OF PERSONAL DATA

The personal data of the data owner is collected and processed for the purposes stated above. The personal data collected will only be processed by a team member in charge at our office. Data will be transferred to other institutions only in cases in accordance with Article 8 of the Personal Data Protection Law if the person concerned is duly informed and his consent is obtained. In accordance with the Personal Data Protection Law, cases where consent is not required or transfer can be made against consent are reserved.  

Article 5 of the Personal Data Protection Law

(1) Personal data cannot be processed without the explicit consent of the data subject. 

(2) Personal data may be processed without seeking the explicit consent of the data subject only in cases where one of the following conditions is met: 

a) it is clearly provided for by the laws. 

b) it is mandatory for the protection of life or physical integrity of the person or of any other person who is bodily incapable of giving his consent or whose consent is not deemed legally valid.

c) processing of personal data belonging to the parties of a contract, is necessary provided that it is directly related to the conclusion or fulfilment of that contract. 

ç) it is mandatory for the controller to be able to perform his legal obligations. 

d) the data concerned is made available to the public by the data subject himself.

e) data processing is mandatory for the establishment, exercise or protection of any right.

 f) it is mandatory for the legitimate interests of the controller, provided that this processing shall not violate the fundamental rights and freedoms of the data subject.

V. THE RIGHTS OF THE DATA SUBJECTS AND THE USE OF THESE RIGHTS

According to Article 11 of the Personal Data Protection Law, the data subject has certain rights.  Article 11: Each person has the right to apply to the controller and 

a) to learn whether his personal data are processed or not, 

b) to request information if his personal data are processed, 

c) to learn the purpose of his data processing and whether this data is used for intended purposes, 

ç) to know the third parties to whom his personal data is transferred at home or abroad, 

d) to request the rectification of the incomplete or inaccurate data, if any, 

e) to request the erasure or destruction of his personal data under the conditions laid down in Article 7, 

f) to request notification of the operations carried out in compliance with subparagraphs (d) and (e) to third parties to whom his personal data has been transferred, 

g) to object to the processing, exclusively by automatic means, of his personal data, which leads to an unfavourable consequence for the data subject, 

ğ) to request compensation for the damage arising from the unlawful processing of his personal data

The rights of the data subjects are regulated under Article 11 of the Law n.6698. You can submit your requests to Mahanoğlu Law Office in accordance with the Declaration on the Procedures and Principles of Application to the Data Controller.

VI. DETAILED INFORMATION ABOUT COOKIES

In this section, the visitor can find detailed information about the categories of cookies used by our website, what they are used for and how they are used. Cookies are used by almost every website and cookies are included in almost every commercial e-mail communication sent over the Internet. Only first-party session and persistent cookies are used on our website as these are absolutely necessary for the provision of the service.

Cookie Varieties 

Types of cookies according to the duration of use: The session cookie is used to ensure the continuity of the session and these cookies are also deleted when the user closes his browser. A persistent cookie, on the other hand, is not deleted when the internet browser is closed and is deleted spontaneously on a certain date or after a certain period of time. In this context, both session and permanent cookies are used on our website. 

First-party and third-party cookies: First-party cookies are placed directly by the website visited by the user, that is, the address shown in the address bar of the browser. Third-party cookies, on the other hand, are placed by a different domain other than the address visited by the user. In this context, first-party and third-party cookies are both used on our website. 

Other than these, personal data of the visitor in question are not transferred directly or indirectly to other data controllers by us. At the same time, the documents containing personal data that are sent to us via our website or e-mail address will be used in accordance with the purposes they contain and documents other than a curriculum vitae will not be collected and destroyed. Personal data in these documents will be processed only by Mahanoglu Law Firm and by the data processors working within our firm. Data will not be accessible by the person/ persons who are not employed in the relevant unit in our office.
